    Determining The Budget :

    The total budget for a project is usually set well before the project brief is prepared. The challenge lies in how to gain the greatest value from the funds available and how to ensure that the project brief adequately reflects what the budget is capable of buying.
    Clients own internal rates are usually determined by multiplying annual salary (professional) by the generally accepted factor of 2.5. This is to cover 'on-costs' of non-technical support staff, holiday pay, sickness pay, workers' compensation, superannuation, insurances, government charges, payroll tax, , materials, rent, other general overheads and profit.
    This is then computed to an hourly rate in the following way:
    Hourly rate = Annual Salary x 2.5 /1505 hours pa (Note: 1505 hours represents 43 weeks to allow for leave, public holidays, etc.)
    For example, costs for a salaried person on $50,000.00 is equivallent to an hourly rate of $83.00 / hr , where as a salaried person on $150,000.00 equates to an hourly cost of $250.00 / hr
    All businesses have peaks and troughs as to work / projects but these costs exist continually minimising company profitability. To use a consultancy in an adhoc as needs basis makes good buisness sense.

    Our consultancy will charge either on an hourly rate or a fixed charge for the whole project.
    Generally the following applies:
    Unpredictable work content is difficult to cost due to the unknown time that will be required to complete the work. If the client and our consultancy cannot identify, with some degree of accuracy, the length of time involved in the project or some specific component of the project, then we will usually seek a fee paid on an hourly basis. Predictable work content is often charged at a fixed fee. A detailed work plan will assist in setting a time frame for the project and allow our consultancy to estimate the time involved and hence the fee to be charged. Travelling, travelling time, out of pocket expenses, overnight accommodation and other expenses such as printing, telephone, postage and computer time must be reimbursed and are additional to the hourly rate or the fixed fee.

    Some points Employer/Clients to consider !

    NSW State legislation requires all workers engaged through all businesses to be covered for Work Cover - it is the LAW, Incorporated Contractors (c/w ABN and GST registration) must provide Certificates of Currency for Workcover and Public liability, this must be disclosed on the Workcover NSW Subcontractor Statement Form.
    Individuals/ sole traders with or without ABN and GST registered are the responsibility of the Client engaging them, an employer cannot contract out of his/her liability under the Act by making a worker sign an agreement to the effect that they are not entitled to claim worker's compensation.
    Same applies to Partnership principals. Partnerships do not qualify for Workcover insurance through their Partnership in NSW.Partnerships will use their ABN and GST registration and issue Tax invoices to the Client / Employer BUT the Employer will be liable for WORKCOVER in the event of any incident and possibly fined at the same time for not ensuring compliance with the legislation, ignorance is no defence.

    An employer cannot contract out of his/her liability under the Act by making a worker sign an agreement to the effect that they are not entitled to claim worker's compensation
    A personal sickness and accident policy cannot be substituted for a worker's compensation Policy

    PAYROLL TAX.....( N.S.W)

    This is a tax imposed by the State Government and is administered by the Office of State Revenue.

    As from the 1st January 1999 the legislation has changed and now it is the responsibility of Employment Agencies to incorporate the payroll tax levy into their hourly charge rates to clients.

    Individual companies using hourly rate contract labour but are under the wages threshold making them not liable for the paying of payroll tax will be discounted accordingly .
    A client declaration form will need to be returned to Commercial Design Consolidated qualifying that they are exempt

    NSW Pay-roll Tax Information - contractors


    Contracts which provide for payments to contractors and subcontractors for work they perform may be liable for pay-roll tax under the Pay-roll Tax Act (1971).
    Contracts which attract a liability for pay-roll tax are referred to as 'relevant contracts' in the Pay-roll Tax Act.

    When pay-roll tax is payable


    Pay-roll tax is payable on contracts when:

    * the contractor or subcontractor works exclusively or primarily for one person or business, and
    * the object of the contract is to obtain the services of the contractor or subcontractor.

    Pay-roll tax is payable whether:


    * the work is done by the contractor in-house
    * goods are given out to a contractor who performs the work and re-supplies the goods.
    This includes the practice of giving out goods to outworkers or home workers.

    Pay-roll tax is payable whether the contractor is an individual, a company, a trust or a partnership.

    See Section 3A (1) (a) (b) and (c) of the Pay-roll Tax Act.

    Contractors - who pays?


    Payments made for contract labour are generally classified as wages, on which pay-roll tax is payable.

    If you pay for the labour of a contractor or subcontractor, you the client are regarded as
    the employer / client and must pay the tax.

    When payments are made directly to a contractor who has set up a company, trust or partnership, these payments are still liable for pay-roll tax by the end user employer / client .
    Pay-roll tax can only become the responsibility of the individual contractor if total wages for that contractors Company, trust or partnership exceeds $600 000 for the Financial year and they are registered with the Office of State Revenue to pay Pay-roll Tax
    Severe financial penalties will be imposed by the OSR against employers / clients engaging
    in creating SHAM contracts with contractors so as to circumvent paying pay-roll tax.

    The amount payable

    You are required to pay the pay-roll tax on the labour + SGL content of the contract.

    Tested in the Courts

    The Payroll tax liability has been tested in NSW , the Administrative Decisions Tribunal found that a certain business in 2004 was liable to pay a substantial amount of disputed payroll tax owing on the remuneration it paid to a group of its contractors, as well as interest and penalties.

    The Tribunal said the provisions were introduced to clarify the liability for payroll tax in non-traditional employment arrangements and to guard against avoidance of payroll tax. The provisions specifically clarify the liability on contract employment for payroll tax.

    It said section 3C of the Act applied in any arrangement where an employer "procures the services" of a contract worker. Under section 3 of the Act, it said the business in question would be deemed to be the employer and the contractor workers deemed to be employees. It found the provisions applied even if the remuneration wasn't paid directly to the contract worker but to that worker's company.

    End user businesses need to sign a client declaration form from the OSR stating they are under the payroll tax threshold if they are to be exempt.
